ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW OR IF YOU OPT-OUT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION PROVISIONS BELOW WHICH ALSO DESCRIBES YOUR RIGHT TO OPT-OUT.

1. Online Shopping
1.1 We are taking care to ensure that all prices, pictures, and descriptions of products appearing on the website are correct. We have made every effort to display as accurately as possible the appearances, colors, textures or finishes of our products that appear on the website. What you see will depend on your monitor and computer equipment, we are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise. Please refer to our Returns Policy if you are unhappy with your purchase.
 
1.2 We will not be liable if for any reason the ecospashop website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all the ecospashop website.
 
 
 
2. Process
Most of the time we do NOT ship orders the same day. It will take 1-2 business days to process your order, regardless of the shipping option selected. We ship Monday through Friday, excluding weekends and holidays. If you placed your order on Monday, your order should ship out on Tuesday or Wednesday. You will receive a tracking number once your order ships.
 
2.1 All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions. Anyone who purchases our products CANNOT go and resell them on amazon, eBay, and etc.
 
2.2 Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
 
The product you ordered is out of stock;
Our inability to obtain authorization for your payment;
We have identified a pricing or product description error;
There is a system or procurement failure.
 
2.3 When you place an order on our website we will email your order detailing the product you have ordered and the payment method used.
 
If you have ordered using the ecospashop Pick-Up Service, we will email you to confirm when your order is ready for collection.
 
 
3. Tracking Your Order
3.1 Once your payment has cleared, we will process your order. You will receive a confirmation e-mail as soon as your order has shipped with the name of the courier and tracking number link to track your package. The tracking information may take 1 – 2 days to show. Sometimes the tracking information is not updated but you will still receive your order. If there is a problem with your package delivery, please contact the courier directly.

3.2 All of our shipments include Tracking with Delivery Confirmation. If the tracking information confirms that the item has been delivered to your order address but you have not received your order, please contact couriers at numbers above in order to investigate this issue. We cannot be held accountable for packages where tracking information states the package has been delivered to your order address.
 
3.3 It is the responsibility of the buyer to make sure that she or he enters the shipping address correctly. We do our best to speed up processing and shipping times, hence there is a very small time gap to cancel/change your order or to change the address of your order. If you decide to cancel your order or change your shipping address, please write to us at support@ecospashop.com as soon as you place your order. We will do our best to make the change, however, we cannot guarantee that we will be able to do so, as there are varying time limits in which we are able to do so.
 
 
4. Eco Spa shop Pick-Up
4.1 We will aim to have orders placed before 4pm available for pick-up the next day.
 
4.3 We will make every effort to make your goods available for pick-up within the estimated timescales. However, delays are occasionally inevitable during a sale or other busy periods or due to unforeseen factors or events outside our control, for example, extreme weather, a flood or fire. ecospashop shall be under no liability for any delay or failure to make the products available for collection within estimated timescales.
 
4.4 Orders will be available for pick-up at a designated collection point in each post office once you have received your pick-up email. Please see your pick-up confirmation email for details of where the pick-up point is located.
 
4.5 To pick-up your order from the post office please make sure that you bring your photo ID.
 
4.6 Risk of loss and damage to the goods passes to you on the date when the goods are collected by you. In the event that a friend collects the goods on your behalf, the risk will pass to you on the date and time the goods are collected by them.
 
4.7 If you fail to pick-up your order within 7 days of your pick-up date, your items will be returned to our distribution center and will be no longer available for pick-up. Refund will be available 21 days of your original pick-up date.
 
 
5. Order Cancellation
5.1 If for any reason, you wish to cancel any order you have placed before it has been delivered or been made available for pick-up using the ecospashop Pick-Up service and it has not been dispatched, you can cancel the order by contacting ecospashop Customer Service team online at support@ecospashop.com
 
5.2 As it is our policy to try to process orders immediately it may not always be possible to stop an order from being dispatched.

7. Payment Methods
7.1 We only accept payment for orders in US Dollar.
 
7.2 We accept payment by MasterCard, Visa, Visa Debit and Paypal.
 
7.3 We are taking all reasonable measures, to keep the details of your purchase and payment secure, but, in the absence of negligence on our part, we will not be liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the ecospashop website. Our site uses industry-standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address and credit card details.
 
7.4 By buying one of our product, you specifically authorize us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including, but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.
 
8. Pricing Policy
8.1 Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as canceled.
 
9. Product Availability
9.1 Once an item is sold out it will be taken off the website at the earliest opportunity and may not be available again. Prices of products may change from time to time. Goods are subject to availability. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

10. Member Account
Registering and using the ecospashop website may involve you setting up an account and giving a password. You are fully responsible for maintaining the confidentiality of your account and the password, and all activities that occur under your account or password. You agree to immediately notify us of any unauthorized use of your account or password and any breach of security or misuse or suspected breach of security or misuse of the service, and ensure that you exit from your account at the end of each session if you use a shared computer. ecospashop cannot and will not be liable for any loss or damage arising from your failure to comply with this Clause 10.
 
 
11. Content/Activity Prohibited
11.1 Please choose carefully the information you post on the ecospashop website and that you provide to other users. You must not misuse the ecospashop website. You will not: send or otherwise post unauthorized commercial communications to users (such as spam); upload viruses, trojans, worms, logic bombs or other malicious code; corrupt data; cause annoyance to others users; post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence; use the ecospashop website to do anything unlawful, misleading, malicious or discriminatory; facilitate or encourage any violation of these Terms and Conditions.
 
11.2 We reserve the right, in our sole discretion, to reject, edit or refuse to post any content and to remove any content from the ecospashop website, whether or not the content is expressly prohibited by these Terms and Conditions, or to restrict, suspend, or terminate your access to all or any part of the Services at any time, for any or no reason, with or without prior notice, and without liability.

ecospashop advises you not to reveal any personal information about yourself or anyone else that would allow you to be identified including but not limited to: telephone number, home address, business address, delivery address or email address.
ecospashop reserves the right to close user accounts if we believe a user is using proxy Internet Protocol addresses (IPs) as a method to hide the use of multiple accounts or to disrupt any of our services in any way. If you use multiple logins for the purpose of disrupting the community we may take action against you and close your accounts.
By submitting any material to us, you automatically grant ecospashop a royalty-free, perpetual, exclusive right and license to use, modify, edit, adapt, publish, re-use, translate, distribute, perform and display such material in whole or part worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.
You acknowledge that we are not obliged to publish any material submitted by you.
By submitting any material to us, you agree to use the ecospashop website in accordance with these Rules and website Terms and Conditions.
If you fail to abide by these Rules you may be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts. Action may include any content posted by you being checked before allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all of the ecospashop website.
ecospashop reserves the right to edit or delete any contribution, or take action against any user account, at any time, for any reason.
If you do not want to grant ecospashop the permission set out above on these terms, please do not submit or share your information.
 
 
12. Liability and Indemnity
12.1 ecospashop shall not be liable for any direct, special, incidental, indirect or consequential damages including loss of profit or loss of opportunity that result from the use of, or the inability to use, the material on this website or the performance of the product purchased through the website or the conduct of other users of this website, even if ecospashop has been advised of the possibility of such damages.
ecospashop.com makes no representations whatsoever about any other web site which you may access through this one or which may link to this Site. When you access a non-ecospashop.com web site, please understand that it is independent from ecospashop.com, and that caresole.com has no control over the content on that web site. In addition, a link to a ecospashop.com web site does not mean that ecospashop.com endorses or accepts any responsibility for the content, or the use, of such web site.
 
12.2 The ecospashop website may also contain links to other websites, which are not operated by ecospashop. When you activate any of these you will leave the ecospashop website and we have no control over, and will accept no responsibility or liability in respect of, the material on any website which is not under our control.
 
12.3 You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.

15.3 If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.

16. Entire Agreement
These Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and ecospashop. 22. Automatic Billing and Cancellation Policy

Some of Modern Collective LLC Premium Services are provided on a subscription basis.  Your subscription will automatically renew at the then-current rate for the subscribed service, until you notify us of your decision to terminate your subscription.  Most subscriptions will renew of one-month terms, regardless of the offer under which that subscription started.

By allowing the renewal to proceed, you have provided your electronic authorization for future charges against the card that you have on file.  You further agree that your subscription fee(s) will be billed automatically at the beginning of each renewal period at the then-current rate (plus sale tax, if applicable) to the credit card(s) you have on file.  If you have more than one card on file, the first card will be used.  If you have more than one credit card on file, and one or more credit cards has expired, we will use the unexpired credit card.

23. Refunds

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

  1. You can return the item opened or unopened, and you’ll need to provide the receipt or proof of purchase. Postage costs for the sending and return of the product are the full responsibility of the claimant and will not be refunded.

SECTION 25 – DISPUTE RESOLUTION BY MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS ARBITRATION PROVISION CAREFULLY TO UNDERSTAND YOUR RIGHTS. EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY CLAIM THAT YOU MAY HAVE IN THE FUTURE MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY. THE RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS DISCOVERY OR THE RIGHT TO APPEAL, MAY BE MORE LIMITED OR MAY NOT EXIST.
 
YOU AGREE THAT YOU MAY ONLY BRING A CLAIM IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF (LEAD OR OTHERWISE) OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU FURTHER AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
 
a. General
 
Arbitration is a manner of resolving a “Claim” without filing a lawsuit. “Claim” means any dispute between you, Modern Collective LLC, or any involved third party relating to your account, your use of the Website, your relationship with Modern Collective LLC, these Terms, or the Privacy Policy. This includes any and all claims that relate in any way to your use or attempted use of the products, and any act or omission by Modern Collective LLC , or any third party related to your use or attempted use of the products. You, Modern Collective LLC, or any involved third party may pursue a Claim. Modern Collective LLC , agrees to final and binding confidential arbitration should it have any Claims against you. Likewise, you agree to final and binding confidential arbitration should you have any Claims against Modern Collective LLC. By agreeing to arbitrate, you waive the right to go to court and agree instead to submit any Claims to final and binding confidential arbitration. This arbitration provision sets forth the terms and conditions of our agreement to final and binding confidential arbitration and is governed by and enforceable under the Federal Arbitration Act (the “FAA”), 9 U.S.C. §§ 1-16, as amended.
 
b. Exceptions
 
Notwithstanding the foregoing, and as an exception to final and binding confidential arbitration, you and Modern Collective LLC both retain the right to pursue, in small claims court, any claim that is within that court’s jurisdiction and proceeds on an individual (non-class) basis, including overdue account matters within the small claims court’s jurisdiction. Modern Collective LLC will not demand arbitration in connection with any individual claim that you properly file and pursue in a small claims court, so long as the claim is and remains pending in that court. The following claims shall not be subject to final and binding arbitration and must be adjudicated only in the state or federal courts located in Texas, Texas: (i) any dispute, controversy, or claim relating to the infringement or validity of our proprietary rights, including without limitation, trademarks, service marks, trade dress, copyrights, trade secrets, or patents; or (ii) an action by Modern Collective LLC for temporary, preliminary, or permanent injunctive relief, whether prohibitive or mandatory, or other provisional relief, against you for breach or threatened breach of this Agreement. You expressly agree to refrain from bringing or joining any claims that are excluded from final and binding arbitration pursuant to this subsection “b” in any representative or class-wide capacity, including but not limited to bringing or joining any claims in any class action or any class-wide arbitration. Small claims matters may be filed in any small claims court with personal and subject matter jurisdiction over the parties. For all other matters excluded from final and binding arbitration by this subsection “b,” the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Texas, Texas, and forever waive any challenge to said courts’ jurisdiction and venue.
 
c. Required Pre-Dispute Procedures
 
We acknowledge and agree that before initiating any Claim against the other, we agree to first contact the other with a written description of the dispute, which shall include all relevant documents and information, and the proposed resolution. You may send the written description of any dispute you have with us by U.S. Mail to 2235 South Cloverdale Avenue, Los Angeles, CA 90016 USA. Modern Collective LLC will contact you by letter at the billing address you provided to us or at the email address you provided to us. You agree to negotiate with Modern Collective LLC or its designated representative in good faith about your problem or dispute. If for some reason the dispute is not resolved within 60 days after receipt of the written dispute, we agree to the dispute resolution provisions below.
 
d. Commencing Arbitration
 
You and Modern Collective LLC agree to commence any arbitration proceeding within 1 year after the Claim arises (the 1 year period includes the required pre-dispute procedures set forth above) and that any arbitration proceeding commenced after 1 year shall be forever barred.
 
e. Arbitration Location
 
For your convenience, the arbitration may be conducted in the federal district where you reside. It may be held by telephone or through written submissions if both you and Modern Collective LLC agree.
 
f. Organization, Rules and the Arbitrator
 
We each agree that any and all Claims other than those exempted under subsection “b” above shall be submitted to final and binding confidential arbitration before a single arbitrator of the American Arbitration Association (“AAA”). Either party may commence the arbitration process by submitting a written demand for arbitration with the AAA, and providing a copy to the other party, within the time period set forth in subsection “d” above. The arbitrator shall be selected by agreement of the parties or, if the parties cannot agree, chosen in accordance with Rules of the AAA. The arbitration will be conducted in accordance with the provisions of the AAA’s Commercial Dispute Resolutions Procedures, Supplementary Procedures for Consumer-Related Disputes, in effect at the time of submission of the demand for arbitration.
The arbitrator shall have the exclusive and sole authority to resolve any dispute relating to the interpretation, construction, validity, applicability, or enforceability of these Terms, the Privacy Policy, and this arbitration provision. The arbitrator shall have the exclusive and sole authority to determine whether this arbitration agreement can be enforced against a non-signatory to this agreement and whether a non-signatory to this agreement can enforce this provision against you or Modern Collective LLC.
 
f. Fees
 
For your convenience, Modern Collective LLC will pay all of the filing costs for the arbitration, including the fees charged by the arbitrator. The parties shall each pay their own additional fees, costs, and expenses, including, but not limited to, those for any attorneys, experts, documents, and witnesses.
g. Governing Law and Award
 
The arbitrator shall follow the substantive law of the State of California without regard to its conflicts of laws principles and may order any relief if permitted by law. The arbitrator may award any form of individual relief, including permanent injunctions and punitive damages, so long as they are in accordance with applicable law and not otherwise excluded by these Terms. The arbitrator may award costs or fees to a prevailing party, but only if the law expressly allows it. Nothing herein shall be construed to limit the arbitrator’s ability to award remedies provided by applicable law. Any award rendered shall include a confidential written opinion and shall be final, subject to appeal under the FAA. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
 
h. Enforceability
 
This provision survives termination of your account or relationship with Modern Collective LLC, bankruptcy, assignment, or transfer. If the class action waiver is deemed unenforceable (i.e., unenforceability would allow arbitration to proceed as a class or representative action), then this entire arbitration provision shall be rendered null and void and shall not apply. If a portion of this arbitration provision (other than the class action waiver) is deemed unenforceable, the remaining portions of this arbitration provision shall remain in full force and effect.
 
i. Miscellaneous
